And we would like at this point to report about\nhow we have been handling it, and to open the conversation about this\nsubject.\n\nWe have a web page about our trademark policy on\nhttps://git-scm.com/about/trademark. There, we list our guidelines for\nothers who would like to use our \"Git\" trademark. Unfortunately a\nnumber of people don't respect our guidelines and use the trademark\nwithout asking us first (sometimes in ways that we might not like).\n\nIf we don't enforce our trademark, there is a risk of us losing any\nright to it. So far we have tried to enforce it, especially in cases\nwhere people want to register a name based on it.\n\nThe issue we have with enforcing the Git trademark is that we don't\nhave much resources to enforce it. And in general we want to avoid\nspending time and money enforcing our mark in all possible instances.\nLegal discussions, going to court, etc can be very time and money\nconsuming, and we would prefer doing more productive things with our\nresources instead.\n\nSo, as much as possible, we don't want to take legal action. For\nexample, we would much prefer to respond to a disagreeable use of our\nmark by first contacting the party and asking politely for them to\nchange their use. Usually this is sufficient to deter infringing uses\nof our mark.\n\nWe would be Ok if necessary to publicly say that for example one\ncompany is using our trademark in a way we don't like. We think that\nthe threat of us doing that (if the company doesn't agree to change\nthe way they use it when we ask politely) is in most cases enough to\ndeter people from using it.\n\nThis way of handling issues has worked well so far. The reason we\nthink it works well, is that people think about the \"Git\" name as very\ncool, and that's why they want to use it in their product or company\nnames. If the Git project would say that it doesn't like the way this\ncompany is using the Git trademark, it would likely create some bad\nbuzz about that company and would go completely against their goal of\nbeing perceived as cool.\n\nNow we cannot be sure that this will always be enough to enforce it in\nthe future. We might have to go to court in some cases. Also we still\nspend some time on this, so another possibility would be to stop\nenforcing the trademark and the logo altogether.\n\nWe also would like to thank the Conservancy and the layers they have\nhired for all the information, help, advice and guidance they have\nprovided on this.\n\nNow we are open to your thoughts about this.\n\nThanks,\nChristian for the Git PLC\n"},{"id":"463292","messageId":"07e739b7-bb60-c23f-7077-2c8f8cc00b62@dunelm.org.uk","threadId":"58423","inReplyTo":"CAP8UFD3WQ64FuXarugF+CJ_-5sFNBCnqPE0AEBK-Ka78ituKTg@mail.gmail.com","subject":"Re: Handling the Git trademark","fromName":"Phillip Wood","fromEmail":"phillip.wood123@gmail.com","sentAt":"2022-09-20T08:38:53Z","receivedAt":"2022-09-20T08:40:22Z","isPatch":false,"sender":{"key":"phillip.wood@dunelm.org.uk","avatar":null},"body":"Hi Christian\n\nOn 13/09/2022 13:11, Christian Couder wrote:\n> Hi everyone,\n> \n> The Git PLC (Project Leadership Committee) is responsible for handling\n> the \"Git\" trademark and the Git logo with help from the Software\n> Freedom Conservancy. My immediate \nreaction is that it would be a shame to lose control of the trademark by \nnot enforcing it. If it is taking up too much of the leadership \ncommittee's time perhaps we could consider asking for more volunteers to \nhandle some of the load. Would a few people volunteering a couple of \nhours a month make a useful difference?\n\nOne other thought is that there are a number of companies which use \n\"git\" in their name that benefit indirectly from the git project \nenforcing the trademark and thereby ensuring the name \"git\" is trusted. \nIf we were ever in the unfortunate position of having to take time \nconsuming (and presumably costly) legal action perhaps we could approach \nthem for support?\n\nThank you to all the leadership committee for the time you spend \nhandling these administrative issues.\n\nPhillip\n\n> Thanks,\n> Christian for the Git PLC\n"},{"id":"463636","messageId":"CAP8UFD3pZLiyDFZTDdMH-_D+d0zp7q0MfiOujf82ZhrLULJwHQ@mail.gmail.com","threadId":"58423","inReplyTo":"07e739b7-bb60-c23f-7077-2c8f8cc00b62@dunelm.org.uk","subject":"Re: Handling the Git trademark","fromName":"Christian Couder","fromEmail":"christian.couder@gmail.com","sentAt":"2022-09-26T15:25:53Z","receivedAt":"2022-09-26T16:39:30Z","isPatch":false,"sender":{"key":"christian.couder@gmail.com","avatar":"https://avatars.githubusercontent.com/u/208954?v=4"},"body":"Hi Phillip,\n\nOn Tue, Sep 20, 2022 at 10:38 AM Phillip Wood <phillip.wood123@gmail.com> wrote:\n\n> Thanks for taking the time to start a discussion on this.
